61억원 가량을 횡령한 혐의로 재판에 넘겨진 박수홍 친형 부부 소송은 예상대로 치열했다.The lawsuit against Park Soo-hong and his brother, who were put on trial for embezzlement of about 6.1 billion won, was as fierce as expected. 특히 친형의 법률대리인이 재판에서 항변하는 모습은 박수홍과 친형, 그리고 박수홍 부모간 갈등의 골이 얼마나 깊은지를 알수 있는 대목이었다.In particular, the fact that his brother's legal representative protested at the trial showed how deep the conflict between Park Soo-hong, his brother, and his parents was.
서울서부지방법원 제11형사부는 20일 박수홍 친형 박씨 부부의 특정경제범죄 가중처벌법상 횡령 혐의 3번째 공판을 진행했다.The 11th Criminal Division of the Seoul Western District Court held its third trial on charges of embezzlement under the Act on the Aggravated Punishment of Specific Economic Crimes by Park Soo-hong and his brother Park. 이날 현장에는 박씨 부부와 변호인 등이 참석했으며 총 5명에 대한 증인신문이 진행됐다.Park and his wife and lawyers attended the scene, and a total of five witnesses were questioned.
이날 증인신문에 나선 5명은 모두 박수홍의 연예활동을 함께 한 매니저와 스타일리스트였다.All five of the witnesses on the day were managers and stylists who worked with Park Soo-hong in his entertainment activities. 이들은 검찰이 물었던 여러 인물에 대해 모두 "잘 모른다"라고 답했다.They all answered "I don't know" about various people asked by the prosecution. 검찰이 언급한 이들은 라엘 또는 메디아붐에서 일을 했다고 박씨 측에서 주장한 인물이었으며 이중에는 박수홍의 부모의 이름도 거론됐다.Those mentioned by the prosecution were those claimed by Park that they worked for Lael or Media Boom, and among them, Park Soo-hong's parents were also mentioned. 하지만 이들은 대체적으로 이를 인지하지 못하는 모습을 보였다.However, they generally did not seem to recognize this aware.
검찰은 이들에게 박씨 부부와의 관계에서부터 라엘과 메디아붐을 인지하는지 여부, 박수홍 활동 관련 각각의 업무에 대한 질문을 이어갔고 박수홍의 현금 및 카드 사용에 대한 부분과 박씨와의 절세 논의 여부에 대해서도 본적이 있는지를 물었다.The prosecution continued to ask whether they recognized Rael and Media Boom from their relationship with Park, and whether they had seen Park's use of cash and cards, and whether they had seen Park's discussion on tax cuts. 박수홍 법률대리를 맡고 있는 법무법인 에스 노종언 변호사에 따르면 메디아붐은 박씨가 대표이사로, 가족들이 지분을 갖고 있고 박수홍의 지분은 없었다.According to lawyer Noh Jong-eon, a law firm in charge of legal representative Park Soo-hong, Park is the CEO of Media Boom, whose family owns a stake, and Park Soo-hong did not have a stake. 라엘의 경우 웨딩업체로 수익을 내다 현재 그렇지 못하고 있으며 박씨와 형수가 공동 대표이사로 등재돼 있다.In the case of Lael, it makes profits as a wedding company, so it is currently not, and Park and his wife are listed as co-CEOs.
이후 박씨 변호인은 이들에게 회사 직원을 알지 못할 수밖에 없는 정황들이 담긴 질문으로 일관했다.Since then, Park's lawyer has consistently asked them questions containing circumstances in which they are bound to not know the company's employees. 또한 한 스타일리스트에게는 채용 과정에 대해 답변이 이해가 가지 않자 "코디 일을 제대로 한 것이 맞냐?"라고 되묻기도 했고, 한 매니저에게는 회사 명의로 박수홍 아내 김다예의 이름으로 입금이 된 사실을 언급, 김다예의 이름으로 울릉도에서 진행했던 행사 출연료 등으로 7000만원이 입금됐다고 언급하기도 했고 '박수홍 여자친구'라는 워딩도 쓰며 박수홍의 이전 행적까지 추적했음을 간접적으로 암시할 정도였다.When one stylist did not understand the hiring process, he asked back, "Did you do the right job?" and mentioned that Park Soo-hong's wife Kim Da-ye was deposited in the name of the company, and indirectly hinted that Park Soo-hong's transfer was tracked. 박씨 변호인은 "박수홍은 이미지 메이킹 전문가로서 수개월 전부터 친형을 악마화했다.Park's lawyer said, "Park Soo-hong has demonized his brother for months as an image making expert. 그런 이후 고소를 했다"라며 "피고인의 악마화된 이미지는 내 주관적인 의견이 아니다"라고 주장하자 검사가 즉각 이의를 제기하기도 했다.Since then, he has filed a complaint," and the prosecutor immediately objected when he claimed, "The accused's demonized image is not my subjective opinion." 이에 변호인은 "공개 법정에서 부동의한 질문을 언급한 것이 부적절한 것을 인정하지만 이미 피고인은 이미 기울어진 운동장에서 패륜범이 돼 싸우고 있는 것"이라고 항변하기도 했다.In response, the lawyer protested, "I admit that it was inappropriate to mention the question of disagreement in the open court, but the defendant is already fighting as a fallow criminal in the already tilted playground." 또한 변호인은 "박수홍의 고소 내용이 가족 간의 일이고 명확한 증거가 없는 부분이 있고 (결국 고소의 근거에는) 박수홍의 진술밖에 없는데 언론을 통해 꾸민, (박수홍이 주장하는) 가공의 인물에 대해 잘 몰랐다라고 주장하는 게 모든 일을 피고인이 했다는 주장을 저희 입장에서는 깨야 방어권이 보장되는데 (김다예 언급은) 중요한 질의"라고 말했다.The lawyer also said, "Park Soo-hong's accusation is between family members, and there is no clear evidence, but Park Soo-hong's statement (the basis for the complaint) is only made by the media. We must break all claims that the defendant did it." 이어 "박수홍이 받아야 할 돈을 박씨에게 요청해서 김다예에게 입금했다.He then asked Park for the money that Park Soo-hong should receive and deposited it to Kim Da-ye. 박수홍이 회사 운영에 관여했다는 점이 입증된 부분이 있다"라고 주장했다.There is a part that proved that Park Soo-hong was involved in the company's management."
검찰도 이에 적극 반박하는 모습이었다.Prosecutors also seemed to strongly refute the allegations. 박씨 변호인이 김다예를 언급하자 "2차 가해"라며 변호인의 질문을 막거나 해당 질문을 왜 하는지 소명해달라고 대응했고, 박씨 변호인이 다음 재판 증인신문에서 박수홍과 박수홍 부모를 함께 대질할 것을 요청하자 "이들을 모두 증인신문을 하는 건 위험할 수 있다.When Park's lawyer mentioned Kim Da-ye, he responded to block the lawyer's question or explain why he asked her to ask, and when Park's lawyer asked her to confront Park Soo-hong and Park Soo-hong's parents at the next trial witness interrogation, "It could be dangerous to interrogate them all as witnesses. 아버지 입장에서 이해가 되지만 불미스러운 일이 있었다.I understand from my father's point of view, but something unpleasant happened. 증인 보호가 필요해 보이며 교차 신문을 하더라도 최대한의 안전이 필요하다"라고 반박하는 모습을 보였다.It seems necessary to protect witnesses, and even if cross-examination is conducted, maximum safety is needed," he refuted.
재판부는 이를 듣고 "박수홍만 증인으로 출석하게 하겠다"라고 답하고 다음 기일을 3월 15일로 정했다.Upon hearing this, the court replied, "We will have Park Soo-hong attend as a witness," and set the next date as March 15.
이로써 박수홍 형제의 법정에서의 재회는 5개월만에 이뤄지게 됐다.As a result, the brothers' reunion in court will take place in five months. 또한 재판부의 이번 증인신문 계획에 대한 결론으로만 봐선 박수홍과 박수홍 부모의 법정에서의 대질은 쉽지 않을 것으로 보인다.In addition, considering the court's plan to interrogate witnesses, it is unlikely that Park Soo-hong and his parents will confront each other in court. 이들이 재회하지 않더라도 이미 형제 간의 재회가 더 큰 법적 공방을 예고하게 할 것이라는 점에서 다른 의미로 안타까움을 더하고 있다.Even if they do not reunite, they are adding regret in a different sense in that a reunion between brothers will already herald a bigger legal battle.
박씨는 2011년부터 2021년까지 연예기획사를 설립해 박수홍의 매니지먼트를 전담하며 회삿돈과 박수홍 개인 자금 등 총 61억 7000만원을 빼돌린 혐의로 2022년 9월 구속 기소됐다.Park was arrested and indicted in September 2022 on charges of stealing a total of 6.17 billion won, including company money and Park Soo-hong's personal funds, by establishing an entertainment agency from 2011 to 2021.
검찰에 따르면 박씨는 박수홍의 개인 계좌에서 29억원을 무단으로 인출하는가 하면 회사 인건비 허위 계상으로 19억원을 횡령한 혐의를 받고 있다.According to the prosecution, Park is suspected of illegally withdrawing 2.9 billion won from Park Soo-hong's personal account and embezzling 1.9 billion won by falsely accounting for the company's labor costs. 또한 회사 자금 11억7000만원을 빼돌려 부동산을 매입하는가 하면 신용카드를 결제 등 방식으로 회삿돈 1억8000만원을 유용한 혐의도 받고 있으며 조사 과정에서 이들이 박수홍의 돈으로 변호사 비용을 지불한 사실도 드러났다.They are also suspected of stealing 1.17 billion won from the company to buy real estate, and using 180 million won from the company through credit card payments, and during the investigation, it was revealed that they paid for lawyers with Park Soo-hong's money.
다만 검찰은 수사 과정에서 합의에 따른 정산 약정금 미지급 등은 혐의가 저촉되지 않는다고 보고 제외했으며 박수홍이 친형 부부 권유로 가입했다는 다수의 생명보험 관련 의혹에 대해서도 보험계약자와 수익자, 보험금 납부 주체가 보험 계약별로 동일해 그 자체로는 범죄가 구성되기 어렵다고 판단했다.However, the prosecution ruled out the failure to pay the settlement agreement due to the investigation, and judged that it was difficult to commit crimes in itself because policyholders, beneficiaries, and insurance payers were the same by insurance contract. 박씨는 앞선 공판에서 자신의 혐의에 대해 일부 공소사실은 인정하지만 법인카드 사용, 허위 직원 급여 지급 등 횡령 혐의 대부분을 부인했다.In the previous trial, Park admitted to some of the charges, but denied most of the charges of embezzlement, including the use of corporate cards and the payment of false employee benefits.
