7일 모코이엔티의 법률대리인 법무법인 바른 측은 "모코이엔티가 가수 김희재 및 그 소속사 초록뱀이앤엠을 상대로 해외 매니지먼트 계약 및 콘서트 계약 불이행 등에 따른 손해배상금 약 6억 4000만 원을 배상하라는 내용의 소송을 제기했다"고 밝혔다.On the 7th, Barun, a legal representative of Moko ENT, said, "Moko ENT filed a lawsuit against singer Kim Hee-jae and its agency Green Snake E&M to compensate about 640 million won for damages caused by overseas management contracts and concert contracts."
모코이엔티는 지난해 7월부터 개최 예정이었던 김희재의 두 번째 단독 콘서트 공연기획사였다.Moko Ent was Kim Hee-jae's second solo concert performance agency, which was scheduled to be held since July last year. 또 지난 2021년 5월 김희재의 해외 매니지먼트 독점 권한대행 계약을 맺은 바 있다.In May 2021, Kim Hee-jae signed an exclusive overseas management agency contract. 이후 김희재는 애초 지난 7월 9일 서울을 시작으로 부산, 광주, 창원 등에서 공연할 예정이었으나 공연을 10일 앞두고 돌연 취소했다.Since then, Kim Hee-jae was originally scheduled to perform in Busan, Gwangju, and Changwon, starting with Seoul on July 9, but suddenly canceled it 10 days before the performance.
이에 모코이엔티는 소장에서 "모코이엔티는 김희재에 대한 매니지먼트 권한을 대행하며 매니지먼트 계약에 따른 계약금뿐 아니라 추후 관련 비용 대부분을 모코가 지급했다"고 밝혔다.In response, Moko ENT said in its complaint, "Moko paid most of the related expenses in the future as well as the down payment under the management contract on behalf of Kim Hee-jae."
콘서트 건과 관련해서는 "피고들(김희재 및 초록뱀이앤엠)은 콘서트의 성공적인 개최를 위해 필요한 자료를 제공하고 안무 및 합주 연습 등 공연 준비에 성실하게 협조할 의무가 있었으나, 이를 이행하지 않은 것이 명백하고 심지어 이행을 거절하기도 했다"며 "이런 이유로 원고 모코에게 발생한 손해를 공동으로 배상할 의무가 있다"라고 밝혔다.Regarding the concert, he said, "Defendants (Kim Hee-jae and Green Snake E&M) were obligated to provide necessary materials for the successful hosting of the concert and faithfully cooperate in preparing for the performance, such as choreography and ensemble practice, but refused to implement it."

모코이엔티는 "이번 사건을 계기로 매니지먼트사 간 약속 불이행 및 연락두절과 같은 관행은 사라져야 할 것"이라며 "연예인으로서 유명세를 이용한 계약을 무분별하게 진행하고 지키지 않고 연락두절 되는 등의 당연시되던 업계교란 행위도 근절돼야 할 것이다.With this incident, practices such as non-fulfillment of promises and loss of contact between management companies should be eliminated, said Moko ENT, adding, "As a celebrity, industry disturbances that have been taken for granted, such as indiscriminately proceeding with contracts using fame, not keeping them, and losing contact should be eradicated. 다시는 이런 일이 업계에 일어나지 않도록 끝까지 법의 테두리 안에서 최선을 다할 것"이라고 전했다.We will do our best within the boundaries of the law to prevent this from happening to the industry again," he said.
한편, 앞서 초록뱀이앤엠이 모코이엔티를 상대로 공연 계약무효 민사 소송은 다가오는 3월 2일로 변론 기일이 잡힌 가운데 "재판 속행"으로 빠르게 진행될 예정이다.Meanwhile, a civil lawsuit for invalidation of the performance contract by Green Snake E&M against Moko ENT will proceed quickly as a "continuation of trial" with the pleading date set for March 2nd.

초록뱀이엔엠은 지난해 11월 24일 서울동부지방법원 민사12단독에서 열린 모코이엔티와 마운틴무브먼트 등을 상대로 낸 계약무효(금전) 소송 첫 변론기일에서 "피고 측이 (김희재가) 처음부터 공연할 의사가 없이 출연료를 받았다고 말하는 식의 기만으로 사기죄로 고소한 상태"라고 밝혔다.Green Snake I.M said in the first pleading date of the contract invalidation (money) lawsuit filed against Moko ENT and Mountain Movement held at the Seoul Eastern District Court Civil Court on November 24 last year, "The defendant (Kim Hee-jae) accused him of fraud."
